However, this state will need to redefine its definition of mental retardation to conform to the recent United States Supreme Court decision Atkins v. Virginia, which held that it is a violation of the United States Constitution to execute persons with an IQ of less than 70.

Clemency: The Governor has the sole authority to commute a death sentence to a term of life without parole.
Who Decides Sentence: Jury
Geographic Disparities: 50% (3) of the people on death row are from Suffolk County in Long Island. Although nearly 1/3 of indictments for 1st degree murder are in Manhattan and the Bronx, Suffolk and Monroe counties sought the death penalty in the highest percentage of cases among all NY counties.
