Clemency: The Governor on the advice of the Parole Board has the power to grant clemency. The Governor needs a favourable recommendation of the Board to be able to grant clemency. The Governor, however, is not bound by the favourable recommendation.
Who Decides Sentence: Judge. However, this state must comply with the recent United States Supreme Court decision, Ring v. Arizona, which states that it is unconstitutional to allow judges to increase jury sentences from life imprisonment to death.
Method of Execution: Indiana authorizes lethal injection. The state switched from electrocution in 1995.
